ARBITRATION |

Arbitration is a process presided over by an independent professional who reviews the evidence and arguments of each disputing party. Upon entering into the arbitration process, parties agree to be bound by the decision of the arbitrator in the same fashion as a contract at common law.
The arbitrator brings disputing parties together in a neutral site and invites evidence and arguments in private and in confidence. The arbitrator maintains neutrality and ensures fairness throughout the process.
Arbitration is an expedient, inexpensive, legally binding dispute resolution process where legal costs are eliminated or minimized. Costs are shared by the parties and decisions are normally given within 10 days of the close of hearing(s). |

The Law and Equity Act of BC now regulates that almost all civil claims are subject to mediation, which is entered into simply after one party files a 'Form 1'. Participation is then mandatory!, with costs shared - like it or not.
